LayerCo is operated by Top End Untold (ABN 75 100 685 375), a sole trader business based in Darwin, Northern Territory, Australia ("LayerCo", "we", "us", "our").
We are committed to handling personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
1. What this policy covers
This policy explains how we collect, use, store and disclose personal information when you:
- Sign up for or use the LayerCo Experience Builder ("the Platform")
- Visit layerco.au or app.layerco.au
- Contact us
If you are an organisation using LayerCo to build an experience, this policy also explains how we handle information about people who play or interact with the experiences you publish ("Players"). Where you collect additional information directly from Players within your experience content, you are responsible for that collection as the experience owner.
2. Information we collect
Account and billing information — name, email address, and organisation name when you sign up. Subscription payments are collected and processed directly by Stripe, our payment processor. We do not collect, receive, or store your card details or full payment information at any point — Stripe handles this entirely on their own secure systems. We only receive confirmation of your subscription status (e.g. active, tier, renewal date) from Stripe.
Experience content — the stops, media, branding and other content you create or upload using the Experience Builder.
Usage and engagement data (Place Pulse) — aggregated data about how Players interact with published experiences, including completions, dwell time, and popular locations. This data is generally analysed in aggregate and is not used by us to identify individual Players.
Technical data — standard web log data (IP address, browser type, device type, pages visited) collected automatically when you use our website or the Platform, for security and analytics purposes.
Correspondence — information you provide when you contact us by email.
3. How we use your information
We use personal information to:
- Provide, operate and maintain the Platform and your account
- Process subscription payments and manage billing
- Provide customer support
- Send service-related communications (e.g. billing notices, product updates)
- Improve the Platform and develop new features
- Comply with our legal obligations
We do not sell personal information to third parties.
4. Who we share information with
We share information with third-party service providers who help us operate the Platform, under contracts that require them to protect your information:
- Stripe — collects and processes your payment and subscription information directly. Stripe acts as an independent data controller for this information, not on our behalf as a mere processor. See Stripe's own privacy policy at stripe.com/privacy for how they handle your payment data.
- Supabase — database hosting and storage (hosted in the Australia [ap-southeast-2] region)
- Resend — transactional email delivery
We may also disclose information where required by law, or to protect the rights, property or safety of LayerCo, our customers, or the public.
5. Where your information is stored
Our primary database infrastructure is hosted in Australia (Supabase, Sydney region). Some third-party service providers (such as Stripe) may process or store data outside Australia as part of their standard operations. Where this occurs, we take reasonable steps to ensure your information receives a comparable level of protection.
6. Data security
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure, including access controls and encrypted data transmission. No online platform can guarantee absolute security, and we encourage you to use a strong, unique password for your account.
7. Access and correction
You can access and update most account information directly within the Platform. To request access to, correction of, or deletion of personal information we hold about you, contact us at info@topenduntold.com.au. We will respond within a reasonable timeframe in accordance with the APPs.
8. Data retention
We retain personal information for as long as your account is active, or as needed to provide the Platform, comply with legal obligations, resolve disputes, and enforce our agreements. You may request account and data deletion by contacting us.
9. Cookies
Our website may use essential cookies required for the site and Platform to function. We do not currently use third-party advertising or tracking cookies.
10. Children's privacy
LayerCo is a business-to-business platform intended for use by organisations and their authorised staff, who must be 18 or over. We do not knowingly collect personal information directly from children through the Platform itself. Experiences published by our customers may be designed for family or general audiences; any information collected from Players within such experiences is the responsibility of the publishing organisation.

If you have a concern about how we've handled your personal information, contact us first at info@topenduntold.com.au so we can try to resolve it. If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
12. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Platform after changes take effect constitutes acceptance of the updated policy.
